RE: Health Sciences Affiliation Agreements and Allied Health Programs - Approval Procedures and Authority to Execute Agreements

A. HEALTH SCIENCES AFFILIATION AGREEMENTS

  1. Health sciences affiliation agreements are legal agreements between the University and a school, hospital or other institution for the provision of a teaching or specialized professional service experience that can be provided only by the University, and for allied health services. Such agreements cannot involve formal proposals from the University to an agency, nor have budgeted line item awards. They are legal agreements that do not involve administration by the Office of Contract and Grant Administration. Income from affiliation agreements for professional clinical services by physicians and non-physicians shall be governed by the appropriate provisions of the health sciences compensation plan and subject to University assessments as provided for in the compensation plan.

    Grants, contracts, and special agreements awarded by the federal government, state, local government, and other nongovernmental funding agencies for research, training, and public service are not considered affiliation agreements. These formal contractual documents normally include specific terms, conditions, budgetary restrictions, report requirements, etc., and are administered by the Office of Contract and Grant Administration.

  2. The Director, Materiel & Risk Management, is redelegated the authority in DA 0916, 12/8/86, to review, approve, and execute affiliation agreements (as defined above) with other institutions and hospitals which do not involve direct financial obligation or commitment on the part of the University. Agreements involving direct financial obligations, or commitments to programs not previously approved, require Regents' approval.

  3. The procedures for execution of affiliation agreements must include the following specific items:

    1. Prior to execution, all proposed agreements must be reviewed and approved by the Chief Operating Officer, UC Irvine Medical Center, and either the Associate Vice Chancellor-Health Affairs Administration or, for nursing sciences, public health, and pharmaceutical sciences programs only, the Associate Vice Chancellor-College of Health Sciences.

    2. All proposed agreements must be reviewed and approved as to form by Campus Counsel-Health Sciences prior to execution unless a standardized form is used which has received prior approval from Campus Counsel-Health Sciences.

    3. Two copies of each executed agreement must be sent to the Vice President-Health Affairs as soon as possible after execution so that the annual reports of affiliation agreements executed under this redelegation of authority may be prepared for submission to The Regents.

B. ALLIED HEALTH PROGRAMS

  1. Review and Approval of Programs

    The Vice Provost-Academic Planning will approve allied health programs, upon the recommendation of the Dean-School of Medicine or, for nursing sciences, public health, and pharmaceutical sciences programs only, the Associate Vice Chancellor-College of Health Sciences. The Dean-School of Medicine and Associate Vice Chancellor-College of Health Sciences are responsible for the development and implementation of review procedures for their respective programs, for the conduct of periodic reviews of any continuing programs, and for assuring that the hospital administration is represented on the review committee.

    "Allied Health Programs" normally will be ones listed for academic credit in the curriculum of a recognized state, community, or private university or college, or in a local school district. However, all programs with an educational component come under this redelegation of authority, unless they are in-service training programs for nurses and other ancillary professionals which are required to meet the standards of the Hospital's external accrediting agencies or to maintain adequate skill levels of staff members, and which do not involve academic credit or continuing education credit.

    Review procedures will be consistent with other planning efforts and will include the evaluation of programs with regard to the educational quality of the program, the use of University space and resources, the impact of the program upon medical education and research programs and their resources, and any financial commitment by the University. Programs having academic approval of the Academic Senate or professional approval of the faculty of the School of Medicine will be reviewed with regard to impact on space and resources of the University.

    Whenever there is uncertainty about whether a program does or does not require review and approval, the Vice Provost-Academic Planning will make that determination.

    Any certificates or certification documents to be awarded trainees at the UC Irvine Medical Center or at a Clinic must meet the approval of the Dean-School of Medicine or, for nursing sciences, public health, and pharmaceutical sciences programs only, the approval of the Associate Vice Chancellor-College of Health Sciences. These documents will be signed by the Chancellor or the Chancellor's designee.

  2. Programs to be Carried on Within Hospital and Clinic Space

    Any allied health programs to be carried on within this space must be reviewed and approved by the Chief Operating Officer, UC Irvine Medical Center, with regard to the financial impact of the programs upon the operations of the hospital and clinics.  This review should occur prior to all other reviews and execution of any agreements or contracts.

  3. The Negotiation of Agreements

    If an agreement with an agency such as a college or school district will be involved, the negotiations of a proposed agreement will be conducted in view of the review and approval procedures described above and below.

  4. Approval of Agreements or Contracts

    If an allied health program will involve an agreement or contract with a non-University of California school or agency, and if the program has received the approvals described above, the Director-Materiel & Risk Management will review and approve the agreement or contract prior to execution by the Vice Provost-Academic Planning. The Director-Materiel & Risk Management will refer to Campus Counsel-Health Sciences any proposed modifications of the standard agreement form for the health sciences clinical experience program, and will recommend for referral to The Regents action any proposed agreements or contracts requiring Regents' action.

This authority may not be redelegated further, and supersedes Chancellor Cicerone’s February 13, 2002 delegation of authority on the same subject, IDA 347.
